Question 1

What is the difference between CDC (Complying Development) and a DA?

Accepted Answer

Complying Development is a fast-track approval via a private certifier or council using statewide SEPP criteria, typically approved in around 20 working days if every numeric standard is met. A Development Application (DA) is assessed by your local council against local LEPs and DCPs, involves public notification, and typically takes several months.

Question 2

Can I build a granny flat on my property without council approval?

Accepted Answer

Under the Housing SEPP, secondary dwellings can often be approved as Complying Development without a DA — provided your land is zoned appropriately (e.g. R1, R2, R3, R4), generally has at least 450m² of lot area, and satisfies setback, floor area and site coverage requirements.

Question 3

What is a Section 10.7 Planning Certificate?

Accepted Answer

Formerly Section 149, a 10.7 certificate is issued by your local council detailing the planning policies and constraints applying to the land. Part 2 discloses zoning and hazards; Part 5 contains additional advice such as draft policies. Every buyer should read one before exchange.

Question 4

Why do DAs take so long?

Accepted Answer

The most common cause is the Request for Information (RFI) — council pausing the assessment clock while waiting for missing or clarified documents. Complete, well-organised lodgements that anticipate specialist referrals move significantly faster.

Question 5

Does buying a toolkit guarantee my project will be approved?

Accepted Answer

No. Toolkits provide general education and structured investigation frameworks. Planning requirements vary by location and proposal, and only your council or a registered certifier can approve development. Toolkits help you arrive at that conversation informed.

Question 6

Is PLAN FIRST NSW a government portal?

Accepted Answer

No. PLAN FIRST NSW is an independent private education and advisory platform. We help you understand the system before you lodge through official channels such as the NSW Planning Portal or your local council.
